Procedures before recruitment
- Register for a business tax code (if you already have a legal entity in Vietnam) or choose an EOR unit in your name (if you do not have a legal entity).
- Build salary scales and payroll (required for businesses with legal entities).
- Prepare labor regulations if expected to employ 10 or more workers.
Procedures for each employee
- Collect personal records: CCCD, diplomas, health certificate.
- Sign a labor contract of the correct type (definite term or indefinite term).
- Register to participate in social insurance - health insurance - unemployment insurance in the first month of work.
- Register for a personal income tax code (if the employee does not have one).
Separate procedures for foreign workers
- Apply for a work permit or permit exemption confirmation.
- Apply for a visa/temporary residence card suitable for work purposes.
- Consular legalization of degrees and criminal records if issued abroad.
Periodic procedures after recruitment
- Report the employment situation periodically to the local labor management agency.
- Year-end personal income tax settlement for employees.
- Renew work permits and temporary residence cards on time (for foreign workers).
How to shorten the entire above procedure
If you do not want to handle each procedure yourself, businesses can hire human resources in Vietnam through the EOR service - the service unit will complete all of the above procedures on their behalf, the business only needs to provide initial information and manage professional work.
How long does the hiring procedure take to complete? For Vietnamese workers, it usually takes 3-7 days if the documents are complete. For foreign workers who need a work permit, you should prepare at least 3-4 weeks in advance.
Can foreign businesses that do not have a legal entity do the procedures themselves? You cannot sign a labor contract in your own name if you do not have a legal entity in Vietnam — this is the reason why you need to use the EOR service so that a unit with a valid legal entity can act on your behalf.
