DECREE Regulating retirement age

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law amending and supplementing a number of articles of the Law on Government Organization and the Law on Local Government Organization dated November 22, 2019;

Pursuant to the Labor Code dated November 20, 2019;

Pursuant to the Social Insurance Law dated November 20, 2014;

At the proposal of the Minister of Labor, War Invalids and Social Affairs;

The Government promulgates the Decree stipulating the retirement age.

Article 1. Scope of adjustment

This decree provides detailed regulations of Article 169 of the Labor Code on retirement age.

Article 2. Subjects of application

1. Employees and employers as specified in Clauses 1, 2, and 3 of Article 2 of the Labor Code.

2. Agencies, organizations, and individuals related to social insurance.

Article 3. Retirement time and time to receive pension benefits

1. The retirement time is the end of the last day of the month reaching the retirement age as prescribed.

For cases where employees continue to work after reaching the retirement age as prescribed, the retirement time is the time of termination of the labor contract.

2. The time to receive retirement benefits begins on the first day of the month following the retirement time.

3. In cases where the worker's records do not specify the exact day and month of birth but only the year, January 1st of the birth year shall be used as the basis for determining the retirement date and the time to receive retirement benefits.

Article 4. Retirement age under normal working conditions

The retirement age of workers under normal working conditions, according to Clause 2, Article 169 of the Labor Code, is specifically regulated as follows:

1. From January 1, 2021, the retirement age of workers under normal working conditions is 60 years and 3 months for male workers and 55 years and 4 months for female workers; thereafter, the retirement age will increase by 3 months each year for male workers until reaching 62 years in 2028 and will increase by 4 months each year for female workers until reaching 60 years in 2035.

2. The schedule for adjusting the retirement age of workers as stipulated in Clause 1 of this Article is implemented according to the table below:

The comparison of the month and year of birth of the employee corresponding to the retirement age provided in this clause is in accordance with Appendix I issued together with this Decree.

Article 5. Early retirement below the retirement age under normal working conditions

Retirement at an age lower than the retirement age under normal working conditions of the employee according to Clause 3, Article 169 of the Labor Code is regulated specifically as follows:

1. Employees in the following cases may retire at a younger age but no more than 5 years earlier than the retirement age specified in Article 4 of this Decree at the time of retirement, except where the law provides otherwise:

a) Employees who have worked for 15 years or more in heavy, hazardous, dangerous, or particularly heavy, hazardous, dangerous occupations or jobs listed by the Ministry of Labor, War Invalids, and Social Affairs.

b) Employees who have worked for 15 years or more in areas with especially difficult socio-economic conditions, including the time working in a location with a regional allowance coefficient of 0.7 or higher before January 1, 2021. The Minister of Labor, War Invalids, and Social Affairs shall issue the list of areas with especially difficult socio-economic conditions.

c) Employees whose working capacity has decreased by 61% or more.

d) Workers have a total duration of working in the occupation or job specified in point a and working in the area specified in point b of this clause of 15 years or more.

2. The minimum retirement age of workers specified in clause 1 of this Article is implemented according to the table below:

The comparison of the month and year of birth of the employee with the retirement age stipulated in this clause shall be according to Appendix II issued together with this Decree.

Article 6. Retirement above the retirement age under normal working conditions

Retirement at an age higher than the normal retirement age of employees under working conditions as prescribed in Clause 4, Article 169 of the Labor Code is specifically regulated as follows:

1. Employees may retire at a higher age if they agree with the employer to continue working after the retirement age specified in Article 4 of this Decree.

2. The termination of the labor contract and the settlement of social insurance benefits for employees as prescribed in Clause 1 of this Article shall be carried out in accordance with the provisions in Section 3, Chapter III of the Labor Code and the provisions of the law on social insurance.

Article 7. Transitional provisions

3. From January 1, 2021, the provisions of the retirement regime associated with the conditions on the age of receiving pension under Articles 54, 55, and Clause 1, Article 73 of the Social Insurance Law shall be implemented according to the retirement age and conditions on the age of receiving pension as stipulated in Article 169, Clause 1, Article 219 of the Labor Code and the provisions of this Decree.

2. For male workers born in December 1960 and female workers born in December 1965 working under normal labor conditions, the retirement date is at the end of December 31, 2020, and the pension entitlement date starts on January 1, 2021.

3. The age milestone for calculating the number of years of early retirement as a basis for reducing the pension rate stipulated in Clause 3, Article 56 of the Social Insurance Law is determined as follows:

a) For workers specified in points a, b, c, d, g, h, and i, Clause 1, Article 2 of the Social Insurance Law

For workers under normal labor conditions, the age milestone is taken according to point a, Clause 1, Article 54 of the Social Insurance Law, amended and supplemented at point a, Clause 1, Article 219 of the Labor Code and Article 4 of this Decree.

Employees working in heavy, hazardous, dangerous, or especially heavy, hazardous, dangerous jobs, or working in areas with particularly difficult socio-economic conditions, including working time in places with a regional allowance coefficient of 0.7 or higher before January 1, 2021, shall have the age reference according to point b, clause 1, Article 54 of the Social Insurance Law, amended and supplemented at point a, clause 1, Article 219 of the Labor Code and Article 5 of this Decree.

Employees working in coal mining jobs in underground mines as prescribed in Appendix III issued together with this Decree shall have the age reference reduced by 10 years compared to the age prescribed in point a, clause 1, Article 54 of the Social Insurance Law, amended and supplemented at point a, clause 1, Article 219 of the Labor Code and Article 4 of this Decree.

b) For employees specified in points d and e, clause 1, Article 2 of the Social Insurance Law.

Employees under normal working conditions use the age benchmark according to point a, clause 2, Article 54 of the Social Insurance Law, amended and supplemented at point a, clause 1, Article 219 of the Labor Code and Article 4 of this Decree.

Employees engaged in heavy, hazardous, dangerous occupations or particularly heavy, hazardous, dangerous work, or working in areas with especially difficult socio-economic conditions, including the time worked in locations with a regional allowance coefficient of 0.7 or higher before January 1, 2021, use the age benchmark according to point b, clause 2, Article 54 of the Social Insurance Law, amended and supplemented at point a, clause 1, Article 219 of the Labor Code and Article 5 of this Decree.

Article 8. Effectiveness

1. This Decree takes effect from January 1, 2021.

2. From the effective date of this Decree, previous provisions that contradict this Decree and the following provisions shall cease to be effective:

a) Article 6; Clause 3 of Article 7 and Clause 2 of Article 11 of Decree No. 115/2015/NĐ-CP dated November 11, 2015, of the Government detailing certain provisions of the Law on Social Insurance regarding compulsory social insurance.

b) Point a, Clause 2 of Article 5 of Decree No. 134/2015/NĐ-CP dated December 29, 2015, of the Government detailing certain provisions of the Law on Social Insurance regarding voluntary social insurance.

c) Points a, b, Clause 1 of Article 8; Clause 3 of Article 9 and Clause 2 of Article 12 of Decree No. 33/2016/NĐ-CP dated May 10, 2016, of the Government detailing and guiding the implementation of certain provisions of the Law on Social Insurance regarding compulsory social insurance for military personnel, public security officers, and cipher-related staff receiving salaries as military personnel.

Article 9. Responsibility for guiding implementation

Ministers, heads of ministerial-level agencies, heads of agencies under the Government, and chairpersons of the People's Committees of provinces and centrally-run cities are responsible for the implementation of this Decree./.

UNDERGROUND COAL MINING WORKS

1. Underground mining.

2. Rock drilling with hand-held pneumatic hammer in the mine.

3. Mine rescue team member.

4. Electromechanical repair in the mine.

5. Operating compressed air, electric, diesel fans, and battery charging stations in the mine.

6. Locksmith, drainage worker in the mine.

7. Coal transportation in the mine.

8. Measure gas, measure wind, monitor air doors, surveying, quality control in the mine tunnel.

9. Workers operate and repair equipment in the mine tunnel.

10. Operate and assist electric locomotives and battery locomotives in the mine tunnel.

11. Operate, repair, and charge batteries in the mine tunnel.

12. Inspect and accept products in the mine tunnel.

13. Storekeeper duties of various types in the mine tunnel.

14. Guard the warehouse in the mine tunnel.

15. Clean the mine tunnel, dredge the sludge in the mine tunnel.

16. Transport materials in the mine tunnel.

17. Fire signal watch in the mine tunnel.

18. Serve meals in the mine tunnel.

19. Install and repair communication systems in the mine tunnel.

20. Operate network stations in the mine tunnel.

21. Guard the air door in the mine tunnel.

22. Direct technical guidance in the mine tunnel.

23. Direct production guidance in the mine tunnel (foreman, deputy foreman, tunnel team leader, tunnel chief).

24. Staff and workers supervise safety in the mine tunnel.
